Welcome to Brio Meals LLC ("Brio," "we," "us," or "our"). By accessing briomealsonline.com or purchasing our products, you agree to these Terms of Service ("Terms"). Please read them carefully.

1. Eligibility

You must be at least 18 years of age and a legal resident of the United States to place an order with Brio Meals.

2. Order Cutoff & Delivery Cycle

Orders must be placed before the weekly cutoff: 12:00 AM EST on the designated cutoff date before each scheduled delivery. Orders placed after this cutoff will be processed for the following delivery cycle.

Once the cutoff time has passed, all orders for that delivery week are FINAL. No modifications, additions, substitutions, or cancellations are accepted after the cutoff due to the perishable nature of our ingredients and our weekly procurement schedule.

Brio reserves the right to refuse, modify, or cancel any order at its sole discretion. If we cancel your order before preparation, you will receive a full refund or store credit.

3. Menu Selection

Customers are encouraged to select their meals for the upcoming week prior to the weekly cutoff. If a customer does not make a menu selection before the cutoff deadline, Brio will automatically assign meals based on the customer’s most recent order history. By subscribing or placing a recurring order, you acknowledge and consent to this automatic selection process. Brio is not responsible for dissatisfaction with automatically assigned meals when the customer had the opportunity to make a selection and did not do so before the cutoff.

4. Account Security

To place orders with Brio, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to: (a) provide accurate and complete information when creating your account; (b) keep your password secure and not share it with any third party; (c) notify Brio immediately at info@briomealsonline.com if you suspect unauthorized access to your account; and (d) accept responsibility for all orders and charges incurred under your account. Brio is not liable for any loss or damage arising from your failure to comply with these account security obligations. We reserve the right to suspend or terminate accounts that we believe have been compromised or are being used in violation of these Terms.

5. Cancellations & Pauses

Customers may pause or cancel their plan at any time prior to the weekly cutoff, which occurs at 11:59 PM (EST) on Thursday before each scheduled delivery. Any changes made after this time will apply to the following delivery week. Paused weeks will not be charged. During initial commitment periods, pauses may be limited. Brio reserves the right to enforce reasonable limits on pauses to ensure operational efficiency. No refunds will be issued for orders that have already been processed or are within the cutoff window.

6. Refunds

Due to the perishable nature of our products, all sales are final once the weekly cutoff has passed.

If your order arrives damaged, incomplete, or compromised in quality, you must:

  • Notify Brio within 24 hours of delivery at info@briomealsonline.com;
  • Provide clear photo documentation of the issue and the use-by label;
  • Retain the affected meals (do not discard) until the issue is resolved.

At Brio’s sole discretion, we may issue a replacement, store credit, or — in rare cases — a partial refund. Refunds are NOT available for: personal taste preferences; claims submitted more than 24 hours after delivery; spoilage caused by failure to refrigerate promptly; damage caused by improper handling after delivery; or missed deliveries due to incorrect address or absence.

7. Brio-Initiated Cancellations

If Brio cancels your order before preparation begins, you will receive a full refund or store credit at your choice within 5 business days.

6. Pricing & Payment

All prices are listed in U.S. Dollars and are subject to change without notice. Brio will provide at least 14 days’ advance notice by email before any change to your recurring subscription price. Sales tax is applied where required by law.

Payments are processed securely through third-party payment providers. By submitting payment, you authorize Brio to charge the total amount shown at checkout, including applicable taxes and delivery fees. Brio does not store full payment card details on its servers.

7. Delivery

Brio currently delivers within designated zip codes in North Jersey. Deliveries are made Sunday through Monday between 10:00 AM and 8:00 PM. You will receive an email and/or SMS notification with your specific delivery window. Delivery windows are estimates and may vary due to traffic, weather, or operational conditions.

Customers are responsible for providing accurate delivery information and for ensuring someone is available to receive the order or that a safe drop-off location is provided.

Risk of Loss. The risk of loss and title to meals passes to you upon delivery of your order to the delivery address you provided at checkout. Brio is not responsible for loss, theft, damage, or spoilage of meals after delivery has been completed.

Brio is not responsible for: (a) spoilage occurring after delivery; (b) incorrect addresses provided by the customer; (c) theft after confirmed delivery; or (d) delays caused by events beyond our control.

8. Meal Substitutions

Given the perishable nature of our ingredients and market and supply conditions beyond our control, Brio reserves the right to adjust, substitute, or remove any meal or ingredient from your order without prior notice. While we make every effort to fulfill your selected menu, substitutions may occasionally be required due to supply shortages, seasonal availability, or quality concerns. Where feasible, we will notify you of any substitution prior to shipment. If you have concerns about a substitution, please contact us at info@briomealsonline.com within 24 hours of delivery.

9. Food Safety, Allergens & Nutritional Information

ALLERGEN WARNING: OUR MEALS ARE PREPARED IN A LICENSED COMMERCIAL KITCHEN IN NEW JERSEY THAT HANDLES AND PROCESSES THE NINE MAJOR ALLERGENS AS IDENTIFIED BY THE U.S. FDA: DAIRY, EGGS, WHEAT (GLUTEN), SOY, PEANUTS, TREE NUTS, FISH, SHELLFISH, AND SESAME.

WHILE BRIO TAKES REASONABLE PRECAUTIONS TO MINIMIZE CROSS-CONTACT, WE CANNOT AND DO NOT GUARANTEE THAT ANY MEAL IS FREE FROM ALLERGENS OR CROSS-CONTAMINATION. CUSTOMERS WITH FOOD ALLERGIES, INTOLERANCES, OR DIETARY RESTRICTIONS ASSUME ALL RISK ASSOCIATED WITH CONSUMING BRIO PRODUCTS AND MUST CONTACT BRIO IN WRITING AT INFO@BRIOMEALSONLINE.COM PRIOR TO PLACING ANY ORDER.

NUTRITIONAL VALUES, INGREDIENT LISTS, AND ALLERGEN INFORMATION DISPLAYED ON OUR WEBSITE ARE ESTIMATES AND MAY VARY DUE TO INGREDIENT SOURCING, PREPARATION METHODS, AND SUPPLIER CHANGES. BRIO DOES NOT WARRANT THE ACCURACY OR COMPLETENESS OF THIS INFORMATION.

Meals contain approximately 28–48 grams of protein per serving depending on meal plans (Lean, Balanced, Performance). Meals must be refrigerated immediately upon receipt and consumed by the use-by date listed on the label.

10. Warranty Disclaimer

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL PRODUCTS AND SERVICES PROVIDED BY BRIO MEALS LLC ARE PROVIDED “AS-IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND. BRIO EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

BRIO DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; (B) ANY DEFECTS WILL BE CORRECTED; (C) THE WEBSITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE NUTRITIONAL, INGREDIENT, OR ALLERGEN INFORMATION DISPLAYED ON THE WEBSITE IS COMPLETE OR ACCURATE, AS SUCH INFORMATION IS SUBJECT TO CHANGE WITHOUT NOTICE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BRIO MEALS LLC’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS, YOUR USE OF OUR PRODUCTS, OR YOUR USE OF THE WEBSITE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO BRIO DURING THE THIRTY (30) DAY PERIOD IMMEDIATELY PRECEDING THE EVENT OR OCCURRENCE GIVING RISE TO SUCH CLAIM.

BRIO SHALL NOT BE LIABLE FOR: (A) ALLERGIC REACTIONS OR ADVERSE HEALTH EFFECTS RELATED TO INGREDIENTS OR CROSS-CONTACT; (B) IMPROPER STORAGE, HANDLING, OR CONSUMPTION AFTER DELIVERY; (C) DELAYS OR FAILURES CAUSED BY EVENTS BEYOND OUR REASONABLE CONTROL; (D) INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; OR (E) DAMAGES ARISING FROM FOODBORNE ILLNESS BEYOND WHAT IS VERIFIED TO BE CAUSED BY BRIO’S DOCUMENTED NEGLIGENCE. THIS LIMITATION APPLIES REGARDLESS OF THE FORM OF ACTION AND EVEN IF BRIO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Force Majeure

Brio is not responsible for delays or failure to perform any obligation under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, weather events, supplier disruptions, labor disputes, transportation failures, public health emergencies, or government actions.

13. Modifications to These Terms

Brio reserves the right to modify these Terms at any time. Material changes will be communicated by posting the updated Terms on our website with a new “Last Updated” date. Continued use of our services after such changes constitutes acceptance of the modified Terms.

14. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms shall be resolved exclusively in the state or federal courts located in New Jersey, except as otherwise provided in Section 15 below.

15. Dispute Resolution & Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Before initiating arbitration, you agree to contact us at info@briomealsonline.com and allow thirty (30) days for informal resolution. If unresolved, except for small-claims court matters, any dispute arising out of or relating to these Terms shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in New Jersey.

YOU AND BRIO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

You may opt out of this arbitration agreement within thirty (30) days of first accepting these Terms by emailing info@briomealsonline.com with the subject line “Arbitration Opt-Out.”

17. SMS Messaging Program

By opting in, you agree to receive promotional and transactional SMS from Brio Meals. Message frequency varies. Message and data rates may apply. You can reply STOP to any Brio Meals SMS to cancel your subscription or opt out at any time. You can reply HELP to get customer support information. Carriers are not liable for delayed or undelivered messages.
